1. Acceptance of Terms

By accessing or using the CatchMyName website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Service Description

CatchMyName is a domain backordering service. We allow users to place backorders on any domain name — including those that are currently registered — and we continuously monitor those domains. If a backordered domain expires, we attempt to register it on the users behalf. Our Service includes:

  • Continuous domain name monitoring (including actively registered domains)
  • Automated domain registration attempts upon release
  • DNS management for acquired domains
  • Domain transfer facilitation

Important: We cannot guarantee that any domain backorder will be successful. Domain acquisition depends on factors outside our control, including whether the current owner renews the domain or another registrar acquires it first.

3. Accounts

To use certain features of the Service, you must create an account. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account

You must be at least 18 years old to create an account and use the Service.

4. Payments and Fees

When you place a backorder, you agree to pay:

  • Domain Registration Fee: Varies by top-level domain (TLD). This covers one year of domain registration if the domain is successfully acquired.
  • Service Fee: A flat $99.00 fee per backorder. This covers our monitoring and registration services.

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the applicable fees.

5. Refund Policy

Our refund policy is designed to be fair and transparent:

  • Failed acquisitions: Full refund (registration fee + service fee) if we are unable to acquire the domain.
  • Cancelled backorders: Domain registration fee is refunded; the $99 service fee is non-refundable.
  • Successful acquisitions: Non-refundable, as the domain has been registered on your behalf.

6. Intellectual Property

The Service, including its design, features, and content (excluding user-submitted data and acquired domains), is owned by CatchMyName and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written permission.

Domain names acquired through the Service are registered in your name, and you are the legal registrant of those domains.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We specifically disclaim:

  • Any guarantee that a domain backorder will be successful
  • Any guarantee regarding the timing of domain registration attempts
  • Any warranty that the Service will be uninterrupted or error-free

8. Limitation of Liability

To the maximum extent permitted by law, CatchMyName shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claims arising from your use of the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account at any time if you violate these Terms or engage in fraudulent or abusive behavior. You may also close your account at any time by contacting us. Upon termination:

  • Active backorders may be cancelled (refund policy applies)
  • Acquired domains remain registered in your name and can be transferred to another registrar

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which CatchMyName operates, without regard to conflict of law provisions.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
